The information provided by TPI View is intended to support the end user’s assessment and interpretation of test data. The end user is responsible for verifying all resulting information and test data and use of TPI View is at the end user’s own risk. TPI makes no representation whatsoever, express, implicit, or otherwise, regarding the accuracy, adequacy, correctness, reliability and/or completeness of any assessment, assumptions, statement, or information provided by TPI View and end user understands and acknowledges that it shall have no claim whatsoever against TPI.
TPI does not collect or store any information or test data. TPI shall not be held liable for any errors or losses incurred or suffered by end user as a result of any settings or information keyed in by end user while using TPI View.
TPI reserves the right to modify, suspend, or discontinue TPI View, or any update thereof, at any time without notice. TPI shall not be liable to end user or any third party for any modification, suspension, or discontinuance. End user acknowledges that certain features or content may not be supported in older versions, and you may be required to promptly install updates to ensure the Application functions correctly
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TPI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) END USERS ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE TPI VIEW; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.
